After an arduous legal battle lasting nearly three years and seven months, the plaintiff, Reuben Hadzide, emerged victorious. The defendant, Nana Owusu Bempah, ultimately agreed to a substantial settlement in the defamation lawsuit brought forth by Reuben Hadzide. The lawsuit made various allegations, including the claim that Reuben had been exploiting the Church of the Ghanaian Community’s 501©(3) status for personal benefit. This case sheds light on the BROKEN conflict resolution mechanisms within the Ghanaian community. Interestingly, in the past two months, four additional lawsuits within the community have either been resolved or dismissed.

The controversy began when Nana Owusu Bempah’s accusations surfaced in his writings, “MATTERS ARISING.” As tensions escalated, this and later other lawsuits embroiled the community in a legal battle that threatened to divide its members further.
The Settlement:
On August 5, 2024, just as the trial in the case of Reuben Hadzide versus Nana Owusu Bempah was about to commence, the parties reached an agreement. Here are the key points of the settlement:

  1. Acknowledgment and Apology: Nana Owusu Bempah acknowledged the well-pledged allegations and sincerely apologized for his conduct.
  2. No Repeat Offense: Bempah agreed not to behave similarly against Reuben Hadzide.
  3. Admission of Innocence: Bempah admitted that Reuben did not steal from the Church.
  4. Financial Settlement: The settlement amount totaled $15,000. Bempah agreed to pay $1,000 by August 6, 2024, followed by monthly payments of $500 due on the fifth of each month until December 2026.
  5. Jurisdiction and Dismissal: The court retained jurisdiction to enforce the settlement terms. The case was dismissed with prejudice.
    Community Reflections:
    Beyond the legalities, this case underscores the need for a robust conflict resolution process within our community. As we move forward, we must consider the following:
  6. Internal Resolution: Rather than resorting to court battles, we should establish a community committee under the auspices of the Ghana National Council (GNC). This committee, comprising clergy, chiefs, queens, and elders, can address disputes promptly and prevent unnecessary resource drain.
  1. Chaplaincy Board: Article XVIII of the GNC constitution calls for creating a Chaplaincy Board representing Christian and Muslim perspectives. One of its primary functions is mediating disagreements and handling cases arising among community members in Chicago and its metropolis.

    While some may claim victories in these lawsuits, the community ultimately loses. We must learn from this experience, treat each other respectfully, and resolve problems promptly. Let us prioritize community cohesion, transparent conflict resolution, and responsible stewardship of our resources. Doing so can prevent future litigation and foster a stronger, more united Ghanaian community in Chicago.
