It is therefore refreshing to hear the current Lands Minister state categorically that President John Dramani Mahama’s RESET AGENDA includes the non-sale of State Lands and Bungalows.
It was great to hear President John Dramani Mahama order an audit of all State Acquired Lands and Bungalows; the report of the audit must be published so Ghanaians will know the status of all State Acquired Lands and Bungalows.
The Lands Minister also announced the retrieval of misallocated State Lands and Bungalows; which necessarily must include the infamous GHc7000 Chief Justice Sophia Akuffo purchase of prime State Lands at Cantonments as well as the Cantonments Civil Aviation Authority Land purchased at ridiculous prices by Chief Justice Georgina Theodora Woode, Ken Ofori-Atta, Governor Addison and Galamsey Queen Kate Gyamfuah which was reported by the ORAL TEAM…
The long list of Land Looters complete with the location of Looted State Lands, size of the Looted Land, amount paid, date of Lease and other particulars of these fraudulent misallocation of State Lands and Bungalows was attached to the Article 146 Petition for the removal of Chief Justice Sophia Akuffo; which document is public record and available to the President, Attorney-General and the Special Prosecutor.
The State Investigative Agencies including the Financial Intelligence Centre should have no difficulty in assisting in the Recover.
President John Dramani Mahama promised to establish a Presidential Commission of Enquiry into the Looted or Stolen State Lands and Bungalows as well as the Expropriation of GaDangme Lands; especially the LA STOOL LANDS which are the most prime lands and most affected by the Looting.
I am aware there is preparatory work underway at the Lands Ministry for which we are most grateful.
The new Land Law ACT 1036 enjoins all fiduciaries including the President who is the TRUSTEE OF ALL STATE LANDS, the Lands Minister, Lands Commission and other officials as well as Chiefs to be transparent and accountable in all Land Transactions or risk sanctions including stiff fines and long terms of imprisonment.
ACT 1036 further requires all Stools to set up Stool Lands Secretariats prior to register all Stool Lands for proper administration; this is a condition precedent to any Land Transaction becoming lawful.
In the case of La which is soon to enstool a new La Mantse; which vacancy has created room for much of the illegality in the Land transactions and is being partly blamed on the absence of the La Mantse, all efforts must be made to close this gap.
The gap notwithstanding, any payments including accrued revenue that has fallen due may be made into an ESCROW account at the bank.
All transactions must be suspended, audited and recommendations carried out to end the vicious cycle that only serves to fuel corruption and laundering of Galamsey money and further Looting of State Lands and Bungalows.
The State must ensure stability and not allow interference especially through the La Traditional Council as was done under Kweku Asoma-Cheremeh and subsequently Samuel Abu Jinapor in the illegal sale of the Cantonments Civil Aviation Authority land and the Labadi Beach Hotel Beachfront.
The proceeds of Galamsey and Corruption end up in foreign offshore accounts, foreign currency under beds or in real estate in prime areas of La notably the Cantonments, Labone, Legon and Airport enclaves usually on State Acquired Lands and Bungalows.
The government cannot fight and win the war against Galamsey and Corruption without ensuring that the La Stool Lands are protected and those the State Acquired are safeguarded.
THE RESET OF THE LANDS COMMISSION is an imperative which must include an Encroachment Prevention Department with an SPECIALISED ARMED SECURITY component which may be outsourced under very strict guidelines for efficiency.
The time has come for greater State-Stool relationship on Land use and Revenue Sharing to replace the third-party allocations which creates instant millionaires at the expense of the original Pre-acquisition Land Owners, the Stools from which government in some instances compulsorily took their lands which they won in conquest with the blood of their ancestors rendering them landless.
The Constitutional Review Process must tighten the provisions that have been abused by the Supreme Court to allow the Land Looting which by the travesty of Justice in the Nii Kpobi Tettey Tsuru III vs Attorney General judgement, was crafted to benefit some corrupt Chief Justices, judges and lawyers among others.
The Constitution of Ghana is explicit about the issue of compensation and return of State Acquired Lands to the Original Pre-acquisition Land Owners.
As La prepares to amicably settle its internal issues and enstool a new Paramount Chief, THE LA MANTSE…
The new La Mantse will also RESET LA, introducing his roadmap which will like the DVLA; all transactions must be done through a Bank; THE LA BANK, from indenture to certification.
The Concurrent Approval of the La Stool Lands Secretariat and Lands Commission will be required in every La Land transaction with the SEAL OF THE LA MANTSE as final authentication for all La Land Transactions.
All Land Certificates will be required to be processed through the La Stool Lands Secretariat, defective titles cured, arbitration in litigation cases settled to bring certainty to the land administration landscape in all La territories, from Peduasi, through Adentan, Madina, Legon, Airport, Cantonments, Labone and all its villages and prestige Beaches.
As President John Dramani Mahama at the United Nations General Assembly requested the payment of REPARATION AND RETURN OF STOLEN ARTIFACTS TO THEIR ORIGINAL OWNERS IN AFRICA…
I respectfully request President John Dramani Mahama to pay outstanding LA STOOL compensation and accrued revenue to an ESCROW ACCOUNT at the La Bank and RETURN UNUSED STATE ACQUIRED LANDS TO THE ORIGINAL PRE-ACQUISITION LAND OWNERS-LA STOOL.
I further request the State to pay Restitution for the effect of the Obnoxious ACT 2 (Protection of Purchasers Law 1960) which was only recently repealed, which set the tone for the disorderly development of Accra, the Looting of Lands and the creation of Landguards.
This template particularly, the setting up of Stool Lands Secretariat as prescribed by ACT 1036 and the mandatory payment of all monies relating to land transactions through a designated bank, should be replicated in all parts of Ghana to encourage all Stools to release Lands to the State for developmental projects and avoid defrauding, double sale of lands, money laundering through land transactions and curb Corruption, Galamsey and the phenomenon of Unexplained Wealth…
