Former Chief Justice Challenges Removal from Supreme Court

Embattled Former Chief Justice Gertrude Torkornoo has filed a review application in the High Court, challenging her removal as a Justice of the Supreme Court.

The application argues that President John Mahama did not follow the proper constitutional procedure outlined in Article 146 for removing a Justice of the Superior Court. Mrs. Torkornoo claims the petitions against her were solely for her removal as Chief Justice, not as a Supreme Court Justice.

Grounds for the Legal Challenge

In her application, Justice Torkornoo asserts that the President’s Warrant of Removal, dated September 1, 2025, is unlawful and void. She alleges several procedural breaches, including the fact that she was never formally served with a copy of the petitions or the prima facie determination against her. She also contends that the Article 146 committee formed by the President lacked the jurisdiction to recommend her removal as a Supreme Court Justice, as its mandate was restricted to her position as Chief Justice.

Seeking Reinstatement and Due Process

Justice Torkornoo is seeking a declaration from the court that the President’s warrant is null and void. She also requests an order of certiorari to quash the warrant, arguing it violates mandatory constitutional provisions for the removal of a Superior Court Justice. The case is based on the claim that her rights were violated because she was not given a copy of the committee’s report and recommendations, which formed the basis for her removal. The court has not yet set a date for the hearing.
